Terms of Service

1. Acceptance of Terms

By accessing or using Low Point Labs (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding agreement between you and Low Point Labs.

2. Description of Service

Low Point Labs provides property-analysis tools and Drainage Intelligence Reports™ produced using our proprietary Low Point Convergence Analysis™ (LPCA™) methodology. Reports are screening-grade documents that may use available elevation, terrain, parcel, climate, soil, flood, wetland, and related data together with modeled features and AI-assisted narrative. Data availability, source, date, and resolution vary by property. Reports are not engineered designs, certified surveys, or regulatory determinations.

3. Invitation Access, Trials, and Accounts

Public self-service registration is not offered. New access is provided through an invitation or other arrangement approved by Low Point Labs. An invitation may provide limited trial access, a trial tier, or report credits under the limits and expiration details shown with the invitation or account. An invitation does not by itself create a paid subscription or authorize a recurring charge.

You must be at least 18 years old to use an account. You agree to provide accurate information, keep credentials confidential, and accept responsibility for activity under your account. Invitations and trial entitlements may not be sold or transferred. We may limit, suspend, or end access that has expired, violates these Terms, or appears fraudulent or abusive.

4. Existing Subscriptions and Billing

The public site does not currently offer new self-service subscriptions or checkout. Some existing customers may have an active subscription or other paid arrangement established previously. For those customers, the billing interval, renewal, quota, price, taxes, cancellation terms, and other commercial terms shown at purchase or in Stripe continue to apply. Recurring subscriptions renew until canceled. We may suspend paid access after a failed payment and may change an existing recurring price only with notice required by the applicable agreement or law.

5. Historical Orders, Credits, and Billing Records

These Terms continue to apply to reports, credits, subscriptions, invoices, and payments created under earlier commercial arrangements. Historical billing and order records may remain available for customer support, accounting, dispute handling, and recordkeeping. Charges are generally non-refundable after a report is generated, subject to the failed or defective report remedy in our Refund Policy.

6. Acceptable Use

You agree not to:

• scrape, mirror, or systematically extract data from the Service;
• resell, sublicense, or redistribute reports except as expressly allowed by written commercial terms;
• submit addresses you do not have a legitimate research interest in;
• circumvent generation limits, share credentials, or otherwise abuse the Service;
• use the Service to violate any law or third-party right.

7. Intellectual Property

Low Point Labs, the LPCA™ methodology, Drainage Intelligence Reports™, the site, the software, the visual design, and our derived analysis are owned by Low Point Labs and protected by intellectual-property laws. You retain any rights you have in notes, drawings, and other content you submit. You grant Low Point Labs a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and transform submitted content as needed to provide, secure, support, and improve the Service.

8. AI-Generated Content

Parts of each report, including parcel-area narratives, are produced with the assistance of large language models. AI-generated text may contain errors, hallucinations, or misinterpretations. You should not rely on AI-generated content as professional advice.

9. Disclaimer of Warranties

The Service and all reports are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Low Point Labs disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Reports are screening tools and are not a substitute for on-site inspection by a licensed professional. See our Report Disclaimer for details.

11. Indemnification

You agree to defend, indemnify, and hold harmless Low Point Labs from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your misuse of the Service; (ii) addresses or content you submit; or (iii) your violation of these Terms or any applicable law.

12. Changes to the Service & Terms

We may modify the Service or these Terms as our offering or obligations change. The “Last updated” date identifies when revised Terms take effect. When appropriate, we may also provide notice by email or in the Service. Continued use after revised Terms take effect constitutes acceptance of those Terms.

13. Applicable Law

These Terms are governed by applicable law. Nothing in these Terms limits a right or remedy that cannot lawfully be waived. The law and forum applicable to a dispute may depend on the parties, location, and any separate written agreement.

14. Resolving Disputes

Before starting a formal claim, please contact us at support@lowpointlabs.com and provide a reasonable opportunity to address the concern. If it cannot be resolved informally, either party may pursue remedies available under applicable law or a separate written agreement.

15. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, Refund Policy, and Report Disclaimer, constitute the entire agreement between you and Low Point Labs.
