Terms of Service

    1. Acceptance of Terms

    By accessing or using Low Point Labs (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding agreement between you and Low Point Labs.

    2. Description of Service

    Low Point Labs provides Drainage Intelligence Reports™ produced using our proprietary Low Point Convergence Analysis™ (LPCA™) methodology. Reports are screening-grade documents derived from publicly available LiDAR elevation data, hydrologic models, and AI-assisted narrative. Reports are not engineered designs, certified surveys, or regulatory determinations.

    3. Accounts

    You must be at least 18 years old to create an account. You agree to provide accurate registration information, to keep your password confidential, and to be responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent or abusive.

    4. Subscriptions & Billing

    Subscription plans are billed monthly in advance and renew automatically until canceled. Current plan tiers and pricing are described on our Pricing page. Fees are exclusive of applicable taxes. If a payment fails, we may suspend access to the Service until the balance is paid. We may change prices on at least 30 days’ notice; price changes take effect at your next renewal.

    5. Single Report Purchases

    Single Reports are one-time purchases tied to a specific address. Once a report has been generated, the purchase is non-refundable except as described in our Refund Policy.

    6. Acceptable Use

    You agree not to:

    • scrape, mirror, or systematically extract data from the Service;
    • resell, sublicense, or redistribute reports outside the bounds of our Wholesale program;
    • submit addresses you do not have a legitimate research interest in;
    • circumvent generation limits, share credentials, or otherwise abuse the Service;
    • use the Service to violate any law or third-party right.

    7. Intellectual Property

    Low Point Labs, the LPCA™ methodology, Drainage Intelligence Reports™, the site, the software, the visual design, and all derived analytics are owned by Low Point Labs and protected by intellectual-property laws. You retain ownership of addresses and notes you submit. You grant Low Point Labs a non-exclusive, worldwide, royalty-free license to process and store submitted addresses as needed to deliver the Service.

    8. AI-Generated Content

    Parts of each report, including parcel-area narratives, are produced with the assistance of large language models. AI-generated text may contain errors, hallucinations, or misinterpretations. You should not rely on AI-generated content as professional advice.

    9. Disclaimer of Warranties

    The Service and all reports are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Low Point Labs disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Reports are screening tools and are not a substitute for on-site inspection by a licensed professional. See our Report Disclaimer for details.

    10. Limitation of Liability

    To the maximum extent permitted by law, Low Point Labs and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service or any report. Our aggregate liability for any claim is capped at the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

    11. Indemnification

    You agree to defend, indemnify, and hold harmless Low Point Labs from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your misuse of the Service; (ii) addresses or content you submit; or (iii) your violation of these Terms or any applicable law.

    12. Changes to the Service & Terms

    We may modify the Service or these Terms at any time. Material changes will be communicated by email or via an in-product notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

    13. Governing Law & Venue

    These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. Subject to Section 14, the state and federal courts located in [STATE] have exclusive jurisdiction over any dispute that is not subject to arbitration.

    14. Dispute Resolution; Arbitration; Class-Action Waiver

    Please read this section carefully. It affects your legal rights.

    Informal resolution. Before filing any formal claim, you agree to contact us at support@lowpointlabs.com and attempt in good faith to resolve the dispute informally for at least 30 days.

    Binding arbitration. Any unresolved dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider in accordance with its consumer rules. Arbitration will take place in the State of [STATE] or, at your option, by video or telephone. Judgment on the award may be entered in any court of competent jurisdiction.

    Class-action waiver. You and Low Point Labs each agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

    15. Miscellaneous

    If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, Refund Policy, and Report Disclaimer, constitute the entire agreement between you and Low Point Labs.
